Terms of Use

1. Agreement

By downloading, installing or using the Doku application ("the App"), or by using the website at poliglotnews.com ("the Site"), you agree to these Terms of Use. If you do not agree, please do not use the App or the Site. In these terms, "we", "us" and "our" mean Poliglot News LLC, a limited liability company registered in the United States.

2. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on a device you own or control, for your own non-commercial entertainment. This licence does not transfer any ownership to you.

3. What you may not do

You agree not to copy, sell, rent, sublicense or redistribute the App; to reverse engineer, decompile or disassemble it, or attempt to derive its source code or puzzle data, except to the extent that applicable law expressly permits this despite this restriction; to remove or alter any proprietary notice; to use the App in a way that breaks the law or infringes anyone's rights; or to interfere with its normal operation, including by tampering with advertising or with the way progress is recorded.

4. Ownership

The App and the Site, including their source code, puzzle content, artwork, sounds, design, text and the names "Doku" and "Poliglot News", are owned by Poliglot News LLC and are protected by copyright and other intellectual property laws. All rights not expressly granted to you are reserved.

5. Advertising

The App is provided free of charge and is supported by advertising served by third parties, currently Google AdMob. Advertisements are supplied by those third parties, and we do not endorse and are not responsible for their content, or for any product, service or website they promote. Your dealings with an advertiser are solely between you and that advertiser. How advertising data is handled is described in our Privacy Policy.

6. Privacy

Our Privacy Policy explains what the App collects, what it does not, and how to turn collection off. It forms part of these terms.

7. Your data and your progress

Game progress is stored locally on your device. We do not operate accounts or cloud backups, and we cannot restore progress that is lost because an app was deleted, a device was reset, or a device was lost or damaged. We recommend nothing be treated as permanently stored.

8. Availability and changes

We may update, change, suspend or discontinue the App or the Site, or any part of them, at any time and without notice. Updates may add, alter or remove features. We are not obliged to provide support, updates or new content, although we intend to.

9. Disclaimer of warranties

The App and the Site are provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, Poliglot News LLC and its members, officers and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or relating to your use of or inability to use the App or the Site, on any theory of liability, even if we have been advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability for all claims relating to the App or the Site will not exceed twenty-five United States dollars (US$25). Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

11. Apple

Where the App is obtained through the Apple App Store, the following applies. Apple is not a party to these terms and has no obligation to provide maintenance or support for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

12. Termination

This licence continues until terminated. It terminates automatically if you breach these terms, and you may terminate it at any time by deleting the App from your devices. Sections 4, 9, 10, 13 and 14 survive termination.

13. Governing law

These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. You and we agree to the exclusive jurisdiction of the state and federal courts located in New York County, New York, for any dispute arising from these terms, except where mandatory consumer-protection law in your country of residence entitles you to bring proceedings elsewhere.

14. Changes to these terms

We may revise these terms from time to time. Continuing to use the App or the Site after a revision means you accept the revised terms.
